The Department of Education on May 6 released its long-anticipated final rule significantly amending the department's existing Title IX regulations.

What Is Title IX?
Title IX of the Education Amendments of 1972 (Title IX) prohibits discrimination on the basis of sex under any education program or activity that receives federal funding. Sexual harassment, which includes sexual assault, is a form of unlawful sex discrimination prohibited under Title IX. In recent years, there has been significant and ongoing policy discussions among federal lawmakers, the Department of Education's Office for Civil Rights, colleges and universities, victim's rights groups, and other key stakeholders regarding the obligations of colleges and universities under Title IX to address the serious problem of campus sexual assault.
On Nov. 29, 2018, the Department of Education issued a notice of proposed rulemaking (NPRM) to amend the Title IX regulations. ACE, along with 60 other higher education associations, submitted comments on the proposed rule in January 2019, as did nearly 125,000 other interested stakeholders.
